Key Provisions of House Bill 59
House Bill 59 was signed into law this summer and became effective July 1, 2024. The law introduces new requirements for HOAs regarding the provision of rules and covenants. Here’s a summary:
- Requirement to Provide Copies of Rules and Covenants – By October 1, 2024, HOAs must provide every member with a physical or digital copy of the HOA’s rules and covenants. HOAs must also provide a physical or digital copy of the rules and covenants to all new members of the HOA. Whenever the HOA’s rules or covenants are amended, an updated copy must also be provided to every member of the association.
- Adoption of Distribution Standards – HOAs may adopt rules to establish standards for distributing documents to the community and the timeframe they must follow for providing copies of updated rules or covenants.
- Use of HOA Website – HOAs may provide documentation by posting the rules and covenants (or a direct link to them) on their homepage, provided the website is accessible to all association members. If posting online, the HOA must notify its members. The notification can be sent electronically to members who have consented to receive notices electronically or via mail.
